EXQLAME: The Exploded Excuse

EXQLAME is more than just a wall of excuses. It's a space where humanity reveals itself: funny, sincere, touching, or offbeat. Here, an excuse isn't a lie—it's an open door to others, to yourself, to a story waiting to be told.

This project was born out of sheer determination: the will to get back up. With no safety net, no money, no help—just the stubbornness to learn, create, and turn a fall into a springboard. What started as a playground for made-up excuses and laughs has become so much more: a place where people dare to post what they wouldn't dare say elsewhere. A sincere message, an outstretched hand, a smile stolen from gloom.

What drives us? Seeing what you make of it. Every day, you reinvent EXQLAME. You turn it into a living, quirky space—sometimes poetic, often funny, always human. You leave words that matter, excuses that free, stories that connect. And that's far more beautiful than anything we ever imagined.

Intellectual Property

Unless otherwise stated, all elements of the EXQLAME website (name, logo, visual identity, design, graphics, templates, card layouts, organization of the "Wall of Excuses," editorial content) are protected by copyright and intellectual property rights.

Prohibited without prior written authorization:
  • Reproduction, representation, modification, adaptation, translation, substantial extraction (scraping), reuse, distribution, or creation of derivative works.
  • Any reuse of the logo or the name EXQLAME.
  • Any imitation or misappropriation of the architecture and concept of the "Wall of Excuses."

Third-party trademarks and logos (Stripe, Google, etc.) remain the property of their respective owners.

Service Description

EXQLAME allows you to post "EXQs" in several formats: Standard, ColorFrame, Chain, Private (via email), and Partner (promotion with logo).

The service may offer free accounts, one-time paid options, and Premium or Premium+ plans.

Certain publications or pages may be linked to professional partners. Such content must be identified as such when its commercial nature requires it.

Prices are in USD. Any currency conversion or bank fees are the customer's responsibility. Payments processed by Stripe.

Order, Payment, Invoice

  • Payments are processed exclusively via Stripe. We never have access to your card details.
  • Publication occurs immediately after payment confirmation (unless moderation/technical error).
  • A payment receipt/proof can be provided (email or download link).

Right of Withdrawal (EU)

Digital content delivered immediately after payment: by ordering, you consent to immediate execution and waive your right of withdrawal (art. L221-28 of the French Consumer Code, if applicable).

Refunds

  • No refunds after the EXQ has been published.
  • Exceptions: bug preventing display, or double payment (refund or credit after verification).

Moderation & Content Responsibility

Users are solely responsible for the content they publish (texts, links, mentions). EXQLAME implements safeguards (automatic filtering, post-moderation, reporting), but cannot guarantee the absence of problematic content.

Prohibited content:
  • Illegal content (hate speech, violence, terrorism, crime glorification).
  • Defamation, privacy violations.
  • Third-party personal data without consent.
  • Illegal pornography, scams/spam.
  • Copyright/trademark violations.

EXQLAME may remove any non-compliant content at its discretion and without notice. EXQLAME cannot be held liable for content published by third parties.

Liability Limitations

EXQLAME is not responsible for service interruptions, technical failures, network unavailability, data loss, or indirect damages. The service is provided "as is."

Reporting

To report content: email contact@exqlame.com with the URL, a clear description, and any useful details. A prompt review will be conducted.

Privacy Policy (Summary)

Data Processed

  • Publication: EXQ text, category, options (frame/private/partner), pseudo/social link (optional).
  • Technical: browser ID stored locally, IP (anti-abuse/quota), preferences (language, etc.).
  • Private: recipient email (to deliver message), optional "from" name.
  • Payment: handled by Stripe; we retain necessary metadata (purchase type, amount, session ID) for proof, anti-fraud, and legal obligations.
  • Audience measurement: no third-party analytics tool is active in V1. If a measurement tool is added in the future, the cookies policy and privacy policy will be updated.

Purposes & Legal Bases

  • Contract performance: publish/deliver EXQ, manage partner content, process payment.
  • Legitimate interest: secure service, combat abuse, measure usage.
  • Consent: optional pseudo/social link, public display option for private EXQ.
  • Legal obligation: accounting/tax retention related to payments.

Retention Periods

  • Public EXQs: according to above rules (7 days, chains 72h per link, partners by window).
  • IP: 1 year (anti-abuse/quota).
  • Private emails: 3 months max (proof of sending/abuse), then deletion.
  • Payment data: up to 10 years (accounting/tax).
  • Local storage (language, local likes, browser ID, free counter): on your device, deletable via browser settings.

Sharing & Transfers

The site and its technical features may rely notably on Firebase / Google Cloud for hosting, authentication, database, and backend functions, on Stripe for payments, and on Cloudflare Turnstile for anti-abuse protection. Some service providers may be located outside the EU; standard guarantees (SCC, etc.) apply where relevant.

Your Rights

  • Access, rectification, erasure, restriction, objection, portability.
  • Withdrawal of consent (without retroactive effect).
  • Complaint to a supervisory authority (e.g., CNIL for the EU).

Cookies & Local Storage

  • No advertising cookies.
  • Local storage (localStorage): language, browser ID, local "like" status/free counter, UI preferences.
  • IP collected server-side for anti-abuse/quota.
  • Audience measurement: no third-party analytics tool is active in V1. If one is added, this section and the cookies policy will be updated.

Minimum Age

Service reserved for individuals 13 years and older. Minors use the service under the responsibility of their legal guardians.

Applicable Law & Jurisdiction

These terms are governed by Mexican law. For users in the European Union, mandatory provisions regarding consumer protection and data protection (GDPR) apply. Exclusive jurisdiction: courts of Mérida, Yucatán.

For EU users, additional GDPR protections apply, particularly regarding privacy and consumer rights.
